Yes — a small classroom waste basket is Tier 1, capped at 5 gallons. The cap exists so ESA buys a desk-side bin, not a kitchen or household garbage can. Above 5 gallons it's a household item.

The mistake families make

One click up to a 7- or 13-gallon office can busts the cap. And recurring trash bags or liners are a household cleaning supply — separately prohibited — so don't let those ride along on the same ESA order.
