Are swimming pools, saunas, ponds ESA eligible in Arizona?
No. Swimming pools, saunas, ponds are on the unallowable purchases list in the SY2025-26 ESA Parent Handbook. Buying them with ESA funds risks the expense being disallowed and repayment being required.

Why ADE says no to pools and saunas
A pool is the backyard's biggest household amenity — installed on the property, used by everyone, valuable at resale. Pools, saunas, ponds, and hot tubs are named together on the prohibited list, the aquatic wing of the home-improvement rule.
The mistake families make
The swim-curriculum inversion. Swimming is on the approved tutoring subjects list, so "we need somewhere to practice" follows naturally — and stops at the property line. The instruction is allowable; the venue, when it's your own backyard installation, is not. Even above-ground seasonal pools are pools.
The allowable path nearby
Swim lessons from a credentialed instructor are allowable as teaching services. A student-only membership at a facility with a pool (a swim club, the Y) is Tier 2 allowable with a curriculum doc — remembering the membership must be for the ESA student alone, not the family. The water can be allowable; owning it can't.
