Are cancellation and late fees ESA eligible in Arizona?
No. Cancellation and late fees are on the unallowable purchases list in the SY2025-26 ESA Parent Handbook. Buying them with ESA funds risks the expense being disallowed and repayment being required.

Why ADE says no to cancellation and late fees
ESA funds pay for education that happens. A cancellation fee, a late charge, a returned-payment penalty — these pay for education that didn't happen, or for administrative friction. The handbook sweeps them all out together, along with fundraising and consultation fees.
The mistake families make
The tutor's invoice with a quiet extra line. A missed lesson last month becomes a "no-show fee" on this month's bill; a therapy practice adds its standard late-cancellation charge. The session lines are allowable, that one line is not — and paying the invoice as-is puts an unallowable amount on the account.

There's no version of these fees that qualifies, so the path is prevention: before paying any provider invoice, scan it for penalty lines and ask the provider to remove them or bill them separately to you personally. Note for therapy families specifically: late and missed-appointment fees are called out as unallowable even when the therapy itself is approved.
